US ITC ruling on Apple Watch ban

Apple is challenging a ruling by the US International Trade Commission that restricts the import and sale of its latest Apple Watch editions. This action stemmed from a patent clash with medical tech firm Massimo. Apple halted both online and in-store sales of the watches a week ago. In a recent statement, the tech giant expressed strong disagreement with the decision, stating, We are actively working to swiftly restore Apple Watch Series 9 and Apple Watch Ultra 2 to our US customers.

Massimo has accused Apple of poaching its staff and stealing its tech. Their legal battle ended in a mistrial, but the US ITC ordered Apple to halt imports and sales of its smartwatches. President Joe Biden had until Christmas to veto the decision but opted not to intervene. Consequently, Apple is pulling two models from its shelves: the Apple Watch Series 9 and Apple Watch Ultra 2. These models feature blood oxygen sensors claimed to infringe on a patent owned by Massimo, according to the US International Trade Commission.

The Apple Watch SE and earlier models don’t include this tech, so you can still find them on shelves for purchase at the moment. Apple has imposed the sales ban, but other major retailers such as Amazon, Best Buy, and Walmart are still offering these watches, despite the ban.
